Terms of Service
Effective 12 October 2026
These terms are an agreement between you and Amir Abed, an individual in California, who runs Deno’s Garden at denosgarden.com ("we", "us"). By using the site or creating an account you agree to them and to our Privacy Policy. If you do not agree, do not use the site.
1. Who can use it
You must be at least 13 to create an account. If you are under 18, a parent or guardian must agree to these terms for you, and only a parent or guardian may buy the paid plan. We do not knowingly collect information from children under 13. If we learn we have, we delete it.
2. Your account
Sign-in is handled by Clerk. Keep your sign-in details to yourself; you are responsible for what happens under your account. Give accurate information and keep your email address current. One account per person.
3. What the site is, and is not
Deno’s Garden is a reference for germinating seeds, drawn from Norman Deno's published work and other public sources. It is provided for general information. It is not professional horticultural, medical, veterinary or safety advice.
- Germination results vary with seed lot, storage and conditions. A protocol is not a promise that seeds will sprout.
- Toxicity information can be incomplete or wrong. Never eat, or let a child or animal eat, any plant on the strength of this site. If you suspect poisoning, call Poison Control (1-800-222-1222 in the U.S.) or a vet.
- Plant identification is automated and is often wrong. Treat a result as a suggestion to check, never as a confirmed identification.
4. Photographs you upload
When you use plant identification, your photographs are sent to Pl@ntNet, a third-party service, to be identified. Only upload photographs you took or have the right to use, and do not upload pictures of people or private information. You give us and Pl@ntNet permission to use your photographs to provide the identification and to improve identification services. See the Privacy Policy for what that includes, among it location information that a photograph may carry.
5. Free and paid plans
A free account includes two plant identifications. The paid plan unlocks unlimited identification, the sowing planner and My Garden, subject to the daily limits of the identification service, and removes advertising (the free site shows ads, fewer to signed-in accounts). It is sold as a monthly or yearly subscription, or as a one-time lifetime plan. The price and billing period are shown before you pay. Subscriptions are processed by Clerk and its payment processor, Stripe; the lifetime plan is paid to Stripe directly. We never see your full card number.
One free offer per person. The free identifications and any free trial of the paid plan are given once per person and email address, not once per account. Deleting an account and signing up again, or using another version of the same address, does not renew them. If a second free trial is started for an address that has already had one, we cancel it before any charge, and subscribing again bills straight away.
Automatic renewal. The paid plan renews automatically at the end of each billing period, at the price then in effect, and your payment method is charged until you cancel. If the price changes we will email you before the renewal it applies to.
Lifetime plan. One payment gives the paid plan's features to the account that bought it, with no renewals, for as long as we offer those features on Deno’s Garden. "Lifetime" means the life of the service, not of the buyer. It belongs to that one account and cannot be transferred, shared or moved to another account. Deleting the account ends it. Buying it while subscribed stops the subscription from renewing; the period already paid for is not refunded. If the payment is refunded or successfully disputed, the lifetime plan is removed.
Canceling. You can cancel at any time on your account page with "Switch to free plan". Canceling stops the next renewal. You keep paid access until the end of the period you have already paid for, then the account moves to the free plan.
No refunds. All payments are final. We do not give refunds or credits for partial periods, unused time, or a period you forgot to cancel, except where the law requires it. A cancellation cannot be undone: to return to the paid plan you must subscribe again and pay again, even if time remained on the period you canceled.
6. Deleting your account
You can delete your account at any time on your account page. Deletion is permanent and takes effect immediately: any paid plan ends at once, without a refund, and your profile and sign-in are removed. What we keep afterwards, and why, is set out in the Privacy Policy.
7. Emails
We email you about your account and payments. We may also email you about our other websites and services, and may share your email address with partners who send their own offers, as the Privacy Policy describes. Every promotional email has an unsubscribe link, and you can opt out of partner sharing at any time.
8. Using the site fairly
Do not:
- get around the free identification limit, the paid plan, or any access control, including with more than one account;
- scrape or download the site in a way that burdens it, or resell its content or identification results;
- interfere with the site's security or operation, or reverse engineer its services;
- upload anything unlawful, harmful, or that you have no right to share;
- use the site to break any law.
We may suspend or close an account that breaks these terms. If we close it for breaking them, no refund is due.
9. Ownership
The site's design, code and arrangement belong to us. Germination protocols are quoted from public-domain sources, and each photograph and fact is credited to its source under that source's licence, as the About page explains. Using the site gives you no other rights in it.
10. Disclaimers
The site is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not promise the site will be uninterrupted, error-free, or that any service, including identification, will stay available.
11. Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost crops, seeds, plants, data or profits, arising from your use of the site. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and US $50. Some places do not allow these limits, so they may not all apply to you.
12. Indemnity
If a claim is brought against us because of something you uploaded, or because you broke these terms or the law, you agree to cover the reasonable costs of that claim.
13. Changes
We may change the site, the plans or these terms. When we change these terms we update the date at the top and, for a significant change, email account holders before it takes effect. Continuing to use the site after that means you accept the new terms. A price change never affects a period you have already paid for.
14. Law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts in Orange County, California, except that either of us may use small claims court. Please email us first; most problems can be fixed without either.
California residents: under California Civil Code §1789.3 you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
15. General
These terms and the Privacy Policy are the whole agreement between us about the site. If part of them cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them to whoever takes over the site.
